The agreement
These terms are an agreement between you and Duckrow Inc., a company incorporated in Alberta, Canada ("Duckrow", "we", "us"). By creating an account or using Duckrow, you accept them.
If you use Duckrow for a company, you confirm you may accept these terms for it, and "you" means that company.
Accounts
- You must be 18 or over and give accurate details.
- We review new sign-ups before opening access, and may decline one.
- Keep your login safe. You're responsible for what happens in your workspace, including what your teammates do.
- Workspace owners and admins choose who joins and what each person can do.
Plans, credits and billing
- Paid plans are billed in advance, monthly or yearly, through Stripe, and renew until you cancel.
- Every plan includes unlimited seats and a number of credits, as the pricing page describes. Credits are used for finding data and for running AI on Duckrow's account, and only when it works: if Duckrow doesn't find what you asked for, the credit is returned.
- Unused credits roll over up to the limit of your plan. Credits have no cash value and can't be transferred or exchanged.
- You can cancel at any time. Cancelling stops the next renewal, and your plan runs to the end of the period you paid for.
- Fees aren't refundable, except where the law requires a refund.
- Prices don't include taxes. We give at least 30 days' notice before a price change affects you.
Your content
Your tables, campaigns and messages are yours. You give us permission to store, process and send them only as needed to run Duckrow for you.
You're responsible for having the right to use the lead data you bring in, and for collecting the consent the law requires.
Contact details Duckrow finds for you come from third-party and public sources, may be incomplete or out of date, and are for your own outreach and business use.
Sending rules
Duckrow sends from your own mailboxes, LinkedIn accounts and registered numbers, so the messages are yours and the rules apply to you. You agree to:
- Follow the laws on commercial messages where you and your leads are, such as Canada's Anti-Spam Legislation, the US CAN-SPAM Act and Telephone Consumer Protection Act, and the GDPR in Europe.
- Honour every unsubscribe and STOP request. Duckrow adds one-click unsubscribe to emails, and opt-out instructions to texts until the person replies; keep them in.
- Text only people who agreed to hear from your business. Bought or rented lists can't be texted.
- Register texting in your own business's name, with accurate details, and keep within carrier rules. Some uses, such as third-party lead generation, can't be texted at all, and carriers block some content outright, such as hate speech or cannabis offers. US carrier registration fees are passed on to you at cost.
- Use LinkedIn within LinkedIn's own rules and limits. Duckrow may slow or limit actions to protect your account.
Acceptable use
You agree not to:
- Send anything illegal, deceptive, harassing or harmful.
- Upload malware, or try to break into, overload or disrupt Duckrow.
- Copy, scrape or reverse engineer Duckrow, or get around its limits or its credits.
- Resell Duckrow without a written agreement with us.
- Resell, share or license contact details found through Duckrow, or use them to build a database of your own for others.
- Put protected health information into Duckrow (we don't sign HIPAA business associate agreements today).
Connected services
Duckrow works with services run by other companies: Gmail and Outlook through Composio (and Gmail through Clayr), LinkedIn through Unipile, texting through our messaging provider, payments through Stripe, plus AI and data providers. Their terms apply to your use of them, and we aren't responsible for their outages or changes. If you add your own API key, your agreement with that provider applies.
Local business listings come from Overture Maps Foundation's open map data, used under the Community Data License Agreement Permissive 2.0 (cdla.dev/permissive-2-0) and, for some sources, the Apache License 2.0. Attribution for each source is listed at docs.overturemaps.org/attribution.
AI and data results
AI answers and found contact details can be wrong or out of date. Duckrow checks emails before saving them, but no check is perfect. Review results before you rely on them.
The service
We keep improving Duckrow, so features change over time. We work to keep it running, but can't promise it will always be available or free of errors.
We may suspend an account that breaks these terms, puts others at risk or goes unpaid. Where we can, we tell you first.
Ending
You can stop using Duckrow at any time. To close your account, email hello@duckrow.ai.
We may end these terms if you seriously or repeatedly break them. When an account closes, you have 30 days to export your data, and then it's deleted.
Privacy
Our Privacy policy explains how we handle personal information, including the lead data we process on your behalf.
Disclaimer
As far as the law allows, Duckrow is provided as it is and as available, without warranties of any kind, including fitness for a particular purpose.
Liability
As far as the law allows, neither side is liable for indirect or consequential losses, such as lost profits or lost data. Duckrow's total liability is limited to the fees you paid in the 12 months before the claim.
You'll cover Duckrow for claims that come from your content or from the messages you send with Duckrow.
Changes to these terms
When these terms change, we update the date at the top. For changes that matter, we tell you by email at least 30 days before they take effect. Using Duckrow after that means you accept them.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any dispute goes to the courts of Alberta.
